1. Acceptance of Terms

By accessing or using White Picket (available at whitepicket.co), including by uploading any documents to the service, you agree to be bound by these Terms and Conditions in full. If you do not agree to these terms, please do not use the service.

2. Description of Service

White Picket is an AI-powered document analysis tool that processes real estate disclosure packages (uploaded as ZIP files containing PDF documents) and produces a report surfacing potential risk flags it is able to detect. The service uses large language models to analyze your documents and generate output.

White Picket is designed to help California home buyers get a faster, more focused starting point for reviewing disclosure packages. It does not guarantee detection of all issues, and results may vary across runs. It is not available as a licensed real estate, legal, or financial advisory service.

3. Data Handling and Privacy

We are committed to handling your data with care and transparency. Here is exactly what we do and do not store:

• Raw uploaded documents: Your original ZIP file and its constituent PDFs are processed in memory during analysis and are not permanently stored on our servers. They are deleted from temporary working storage once analysis is complete or the session expires.
• Extracted text: Text extracted from your documents is transmitted to third-party AI providers for analysis, subject to their respective privacy policies. We do not control how these providers handle data once transmitted.
• Analysis reports: The generated analysis report (PDF and HTML format) is stored in cloud storage (Firebase Storage) to allow you to access your report after the analysis completes. Reports are associated with a unique session identifier, not your personal identity.
• Email address: If you voluntarily provide your email address to receive a copy of your report, it is used solely to deliver that report. We do not use it for marketing without your explicit consent, and we do not sell or share it with third parties.
• No accounts required: White Picket does not require you to create an account. No login credentials, passwords, or personal profiles are created or stored.

4. AI-Generated Content - Not Professional Advice

All reports generated by White Picket are produced by artificial intelligence and are provided for informational purposes only. They do not constitute professional real estate, legal, financial, structural, or engineering advice.

• White Picket reports are not a substitute for advice from a licensed real estate agent, attorney, home inspector, structural engineer, or any other qualified professional.
• AI-generated content may contain errors, omissions, misclassifications, or inaccuracies inherent to the technology.
• The service does not guarantee that all issues present in a disclosure package will be detected. Results may vary across runs on the same documents.
• Reports should not be the sole basis for any purchasing decision, financial commitment, or legal action.
• You are solely responsible for verifying any flags or findings with qualified professionals before acting on them.

5. Disclaimer of Warranties

White Picket is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We expressly disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, free from harmful components, or that any specific result will be achieved through use of the service.

6. Limitation of Liability

To the fullest extent permitted by applicable law, White Picket and its operators, affiliates, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the service, including but not limited to:

• Errors, omissions, or inaccuracies in AI-generated analysis reports.
• Any decision made in reliance on a White Picket report, including purchasing or declining to purchase a property.
• Losses arising from property defects that were or were not identified by the service.
• Interruption, downtime, or unavailability of the service.
• Unauthorized access to or alteration of data during transmission or storage.
• Any issue arising from third-party AI providers processing your document data.

In no event shall our total aggregate liability to you for all claims arising from your use of the service exceed the greater of: (a) the total amount paid by you to White Picket in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

7. User Responsibilities

By using White Picket, you represent and warrant that:

• You have the legal right to upload and process the documents you submit.
• You will not upload documents containing malicious code, viruses, or content intended to harm our systems or other users.
• You will not use the service for any purpose that is unlawful or prohibited by these terms.
• You understand the AI-generated nature of reports and will seek qualified professional advice before making significant real estate or financial decisions.
• You will not resell, redistribute, or commercially exploit analysis reports generated by White Picket without our prior written permission.

8. Third-Party Services

White Picket relies on third-party services to operate, including AI analysis providers, Google Firebase (hosting, storage, database), and Resend (email delivery). Your use of White Picket is also subject to the applicable terms and privacy policies of these providers. We are not responsible for the data practices, accuracy, or availability of these third-party services.

9. Intellectual Property

The White Picket service - including its software, design, branding, and methodology - is the intellectual property of WhitePicket.co and is protected by applicable copyright, trademark, and other intellectual property laws.

You retain all ownership rights to the original documents you upload. The analysis reports generated from your documents are licensed to you for personal, non-commercial use. Resale or public redistribution of White Picket-generated reports without prior written permission is prohibited.

10. Modifications to Service and Terms

We reserve the right to modify or discontinue the service (or any part of it) at any time, with or without notice. We also reserve the right to update these Terms and Conditions at any time. Changes take effect upon posting to this page with an updated date. Your continued use of White Picket after changes are posted constitutes your acceptance of the revised terms.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
